A Resource for Automated License Plate Reader and Body-Worn Police Camera Audits
In reference to Minnesota Statute 13.824 and 13.825 beginning in 2022 Biennial audits are now required for all Automated License Plate Readers and Portable Recording Systems, respectfully. Crescent Investigate Services is one of few agencies to offer this audit service.
Beginning with Statute 13.824 (subd. 6.) the law enforcement agency must maintain records showing the date and time automated license plate reader data were collected and the applicable classification of the data. Similarly, in accordance with Statute 13.825 (subd. 9.) a law enforcement agency must maintain records showing the date and time portable recording system data were collected and the applicable classification of data. Crescent Investigative Services will audit records to determine whether the data is classified, destroyed, and verify compliance. If an agency fails to comply they are subject to exemplary damages.
A report summarizing the results of audits are required to be provided to the appropriate parties within 30 days of the License Place Reader audit’s completion and 60 days for Body Worn Cameras. An example of what your audit would include reviewing:
